NSA General Counsel Rajesh De says the NSA is using the same tactics as the NYPD.

“It’s effectively the same standard as stop and frisk,”De explained at a Privacy and Civil Liberties Oversight Board hearing.

Robert Litt, general counsel at the Office of the Director of National Intelligence, disagreed. He said the “actual degree of intrusion” when the NSA sniff out the phone call database “is considerably less” than a stop and frisk search.

U.S. District Judge Shira Scheindlin ruled New York City’s stop and frisk unconstitutional. In rare move last week, however, the 2nd U.S. Circuit Court of Appeals threw Scheindlin off the case because it claimed she “ran afoul” of the judicial conduct code.

New York City Mayor Michael Bloomberg is trying to get the Fourth Amendment busting tactic reinstated by asking the appeals court to overturn the ruling before his successor, Bill de Blasio, takes office. Mr. de Blasio is staunch critic of stop and frisk.
