A grandmother in Fresno, California was left with several fractured bones and a dislocated shoulder after being attacked by a police officer for the crime of trying to deliver cupcakes to her grandchildren.

78-year-old Mary Poole was attempting to give the treats to the children while they were at Kastner Intermediate School. Poole opted to do this because their parents are currently embroiled in divorce and custody proceedings.

“I hadn’t seen my granddaughters for some time and I wanted to see them, and so I baked some cupcakes and bought some cookies for my granddaughters’ classroom,” Poole told reporters with a local ABC affiliate.

However, the gesture was not welcomed by the Clovis Unified police officer, who falsely claimed that Poole was not allowed to see the children due to a court order.

As Poole began to leave the school grounds, she decided to call her son to explain the situation. Clearly aggravated by Poole’s refusal to accept his false claims, the cop became violent, grabbing the grandmother and pepper spraying her in the face as she struggled to break free.

“He wouldn’t listen to anything I had to say, period. Every time I tried telling him anything…I mean, I was even telling him, ‘I’m 78 years old,’ before he grabbed me. He sprayed me with mace twice,” Poole said.

Poole stands at under 5 feet and about 110 pounds, hardly a match for any police officer.

“I was very frightened, and I told him to call the police and he said, ‘I am the police. He jerked me out of my car with my left arm with such great force, and then threw me onto the pavement. From there he dragged me by my left arm up to the school grounds,” she added.

Poole’s injuries at the hands of the cop equated to more than $180,000 in medical bills. She has filed a lawsuit alleging police brutality and elderly abuse.

“The amount of force it took to inflict these injuries is testament to what happened that day,” said Mark Coleman, Poole’s attorney.
