Republican presidential candidate Lindsey Graham told Fox News Donald Trump’s plan to address illegal immigration and the issue of birthright citizenship is “stupid” and “illegal.”

Graham said if the government attempts to deport the American-born children of illegal immigrants they will “get creamed in court.”

“I find him offensive,” he said. “His solution is just constitutionally flawed. It’s not practical.”

Graham and other proponents of illegal immigration cite the Fourteenth Amendment of the Constitution when they defend so-called birthright citizenship.

“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside,” the amendment states.

Fourteenth Amendment Invalid

Rarely mentioned is the fact the Fourteenth Amendment is invalid.

The Fourteenth Amendment was added to the Constitution on July 9, 1868, as one of the so-called Reconstruction Amendments (the others are the Thirteenth and Fifteenth amendments).

The Fourteenth Amendment is invalid and unconstitutional due to the fact the joint resolution calling for its adoption was not submitted the Constitutional Congress per Article I, Section 3, and Article V of the Constitution or sent to the president for his approval.

Moreover, the proposed amendment was rejected by more than one-fourth of all the States then in the Union, and was never ratified by three-fourths of the States.

Congressman John R. Rarick of Louisiana also made a principled argument against the amendment on the House of the Floor.
