The judge presiding over Massachusetts Senate candidate Marty Gottesfeld’s federal court case has a clear conflict of interest and has appointed a lawyer who, according to Marty, is not fit to be involved in such a high-profile case.

Gottesfeld is known as the “hacktivist” who allegedly took down the Boston Children’s Hospital’s (BCH) website with a DDoS attack in April of 2014.

Marty says he took down the site to defend Justina Pelletier, a learning-disabled young girl whom he believed, for good reason, was being “tortured” by BCH.

Gottesfeld thinks federal Judge Nathaniel M. Gorton should recuse himself from the case due to the fact that he sat on the board of the Home for Little Wanderers, a 501(c)3 which accepted $50,000 from Boston Children’s Hospital in September 2015.It was Judge

Gorton also presided over the nationally covered Aaron Swartz case.

Judge Gorton recently appointed lawyer Ray Gillespie as Marty’s counsel and will not allow Gottesfeld to fire him and get another attorney.

Marty argued that Gillespie is not an adequate counsel and argued that he may not be in a position to represent anybody as his practice reportedly carries no malpractice insurance whatsoever.

Like Gorton, Gillespie has ties to BCH through his reported connection to Stephanie Engel, a Harvard Psychiatry MD who he may have worked with and is listed at the same business address as Gillespie’s (former) practice.

According to the Pelletier family’s lawsuit against Boston Children’s Hospital and four of its doctors, it was Harvard psychiatrists who recommended that their custody rights be permanently and irrevocably terminated.

In addition, Gillespie is said to spend the majority of his time on personal injury law, making him an odd selection for such a high-profile defendant.

Gorton and Gillespie aren’t the first individuals involved in Marty’s case who appear to have conflicts of interest.

Federal Magistrate Judge Marianne Bowler, who issued his original search warrant and stopped him from being with his father on his deathbed, worked for Harvard Medical School and is currently married to one of its professors.

Bowler also sat on the board of the Boston Foundation, which actively raises money for BCH.

When Marty requested a “motion to revoke custody” in an attempt to attend his father’s funeral, Bowler also denied that motion.
