A restaurant fight turned deadly for one of the combatants when he died at a hospital after a Phoenix police officer shot him with a Taser on Sunday night.

The fight between two men started about 10:30 p.m. inside Freddy’s Frozen Custard and Steakburgers, near 49th Avenue and Bell Road.

One man began fighting with a police officer, who was forced to use his Taser on the man. Minutes later, the man stopped breathing and was taken to the trauma center at John C. Lincoln Medical Center, where he later died, police said.

Editor’s note: Courthouse News Service reports that a man’s family is filing a federal complaint against Phoenix police and Taser international, claiming police Tasered him for 53 seconds and choked and hogtied him. As yet, it is unclear if these are the same cases.
